Does the daughter have any recourse of Paying For Nursing Home?

QUESTION:

What do you think of a nursing home, doctor, and spouse who work together to force a 94-year old man take a drug (Zoloft) against his will...just to keep him from wanting to go home?
His daughter objected, and the nursing home immediately retaliated by discontinuing physical therapy so Medicare would stop paying the $4,600 a month nursing home bill.
Does the daughter have any recourse?

ANSWER:

Zoloft is an anti-depressant. What makes you believe that taking it prevents the man from leaving the nursing home? Why would the nursing home try to have his Medicare cut off? If he doesn't have Medicare how will the nursing home be paid? If the daughter is not his legal guardian she probably doesn't have much recourse. If the man or his guardian doesn't like this nursing home he should move to another nursing home.
